This is not a 2nd Amendment question. The CMP does not prevent you from purchasing a 1911 from other sources.
Your question has been asked and answered. The federal statute that enables the CMP to sell these pistols stipulates that they must have a positive background check before they can ship. They are only complying with the law that allows them to function.
