    Whoever designed that web site should be shot at dawn. The article is almost impossible for aging eyes to see, let alone read.

    Fortunately, I already knew about this decision, and it is good news -- as far as it goes. The State of Maryland can still petition to have the appeal re-heard before the entire circuit court (this decision came from a 3-member sub-panel). And there's still the possibility/probability that the lower court will play games when they reconsider, and apply a lower level of intermediate scrutiny while calling it strict scrutiny.

    It's a favorable decision, but the game is still in the early innings.

    The District Court will actually have to hear arguments and not just pass summary judgement as it did the first time. It will be interesting to see if en blanc is granted, and if so, if there is a different outcome. This case is bound to go around and around for the next few years.

    So part of this case goes back before the same Judge that found that semi-automatic rifles are more dangerous than fully-automatic rifles? Oh boy . . .

    With explict instructions that she MAY NOT MAKE A RULING BASED ON HER FEELINGS as she did the first time. I'm betting on her suddenly having a medical leave of absense because she doesn't have the stomach to hear the case out.
